CONTROLLER<\/h2>\n<p>The controller of personal data is New BTS, a.s., with registered office at Kot\u011brova 2037\/1b, 613&nbsp;00 Brno, Company ID: 277&nbsp;45&nbsp;333, VAT ID: 27745333, registered in the Commercial Register maintained by the Regional Court in Brno under file no. B 5021 (hereinafter referred to as the &#8220;Controller&#8221; or &#8220;we&#8221;).<\/p>\n<h2>B. PURPOSES AND LEGAL BASES FOR PROCESSING<\/h2>\n<p>We process personal data for the following purposes:<\/p>\n<ol type=\"a\">\n<li>conclusion and performance of contracts with the guest, based on the performance of the contract if the accommodation contract is concluded with a&nbsp;natural person, or based on our legitimate interest consisting in the performance of the contract with the guest if the contract is concluded with a&nbsp;legal entity;<\/li>\n<li>internal administrative needs, creation of statistics and records, based on our legitimate interest in ensuring proper records of contracts concluded with guests;<\/li>\n<li>sending newsletters and commercial communications, based on our legitimate interest in promoting our services to guests;<\/li>\n<li>protection of legal claims, based on our legitimate interest in ensuring proper protection and effective assertion of our rights and claims;<\/li>\n<li>protection of property and persons, based on our legitimate interest in ensuring the protection of our property, property of employees and third parties, and ensuring security; and<\/li>\n<li>fulfilment of general legal obligations, particularly in the area of tax, accounting and registration, based on legal obligations applicable to us as the controller.<\/li>\n<\/ol>\n<h2>C. PROCESSED PERSONAL DATA AND RETENTION PERIOD<\/h2>\n<p>For the above purposes, we process in particular:<\/p>\n<ol type=\"a\">\n<li>identification and contact details;<\/li>\n<li>data about accommodation and services used, such as accommodation dates;<\/li>\n<li>payment data, such as the amount and method of payment for accommodation,<\/li>\n<li>records of mutual communication.<\/li>\n<\/ol>\n<p>We obtain this data directly from you by filling in the relevant forms and contractual documentation, or from third parties who book accommodation on your behalf. In addition, to a&nbsp;limited extent, we obtain and further process personal data from publicly available sources, which are public registers (e.g., insolvency register or enforcement records), always in accordance with legal requirements.<\/p>\n<p>We retain personal data to the necessary extent for the period of:<\/p>\n<ol type=\"a\">\n<li>duration of the relevant contract in the case of the purpose under letter a) above;<\/li>\n<li>duration of the relevant contract and subsequently until you unsubscribe from the newsletter with respect to your email address, or for the period of<\/li>\n<li>duration of the relevant contract and subsequently 5 years from its termination with respect to data other than email address and the purpose under letter c) above;<\/li>\n<li>duration of the limitation period, including the period covering its possible suspension or interruption, typically no longer than 10 years after the termination of the contract in the case of purposes under letters b), d) and e) above; and<\/li>\n<li>duration of the relevant legal obligations in the case of the purpose under letter f) above.<\/li>\n<\/ol>\n<h2>D. WHO PROCESSES YOUR PERSONAL DATA AND TO WHOM DO&nbsp;WE TRANSFER IT?<\/h2>\n<p>All mentioned personal data is processed by us as the controller. This means that we determine the purposes defined above for which we collect your personal data, determine the means of processing and are responsible for its proper execution.<\/p>\n<p>We generally do&nbsp;not transfer your personal data to other controllers. Exceptions are cases where we are required to transfer this data by law (especially to tax authorities, courts and police in the exercise of their legal powers), and cases where we transfer this data to achieve the above purposes to state authorities or third parties (especially persons harmed by unlawful conduct).<\/p>\n<p>We also involve other entities in the position of processors who process personal data for our company and according to our instructions. These include in particular:<\/p>\n<ol type=\"a\">\n<li>providers of information systems and technical infrastructure; and<\/li>\n<li>marketing agencies.<\/li>\n<\/ol>\n<p>All processors are bound by a&nbsp;processing agreement to comply with the requirements of legal regulations on the protection of personal data, in particular to protect your personal data.<\/p>\n<h2>E. WHAT RIGHTS DO&nbsp;YOU HAVE IN THE PROCESSING OF PERSONAL DATA?<\/h2>\n<p>Just as we have our rights and obligations when processing your personal data, you also have certain rights when processing your personal data. These rights include:<\/p>\n<h2>E.1 Right of Access<\/h2>\n<p>Simply put, you have the right to know what data we process about you, for what purpose, for how long, where we obtain your personal data, to whom we transfer it, who processes it besides us, and what other rights you have related to the processing of your personal data. You have learned all this in this Information on the Processing of Personal Data. However, if you are not sure which personal data we process about you, you can ask us to confirm whether or not personal data concerning you is being processed by us, and if it is, you have the right to access it. As part of the right of access, you can ask us for a&nbsp;copy of the processed personal data, and we will provide you with the first copy free of charge and additional copies for a&nbsp;fee.<\/p>\n<h2>E.2 Right to Rectification<\/h2>\n<p>If you find that the personal data we process about you is inaccurate or incomplete, you have the right to have it corrected or supplemented without undue delay.<\/p>\n<h2>E.3 Right to Erasure<\/h2>\n<p>In some cases, you have the right to have your personal data erased. We will erase your personal data without undue delay if one of the following reasons is met:<\/p>\n<ol type=\"a\">\n<li>We no longer need your personal data for the purposes for which we processed it.<\/li>\n<li>You exercise your right to object to processing (see below chapter &#8220;Right to Object to Processing&#8221;) for personal data that we process based on our legitimate interests, and we find that we no longer have any such legitimate interests that would justify this processing.<\/li>\n<li>It turns out that our processing of personal data is no longer in accordance with generally binding regulations.<\/li>\n<\/ol>\n<p>This right does not apply if the processing of your personal data is still necessary for:<\/p>\n<ol type=\"a\">\n<li>fulfilment of our legal obligation;<\/li>\n<li>archiving purposes, scientific or historical research, or statistical purposes; or<\/li>\n<li>establishment, exercise or defence of our legal claims.<\/li>\n<\/ol>\n<h2>E.4 Right to Restriction of Processing<\/h2>\n<p>In some cases, instead of the right to erasure, you can exercise the right to restriction of processing of personal data. This right allows you in certain cases to require that your personal data be marked and not be subject to any further processing operations \u2013 in this case, however, not permanently (as in the case of the right to erasure), but for a&nbsp;limited time. We must restrict the processing of personal data if:<\/p>\n<ol type=\"a\">\n<li>you contest the accuracy of personal data, until we agree on what data is correct;<\/li>\n<li>we process your personal data without sufficient legal basis (e.g., beyond what we must process), but you will prefer only their restriction before the erasure of such data (e.g., if you expect that you would provide us with such data anyway in the future);<\/li>\n<li>we no longer need your personal data for the above processing purposes, but you require them for the establishment, exercise or defence of your legal claims; or<\/li>\n<li>you object to processing. The right to object is described in more detail below in the chapter &#8220;Right to Object to Processing&#8221;. During the period in which we investigate whether your objection is justified, we are obliged to restrict the processing of your personal data.<\/li>\n<\/ol>\n<h2>E.5 Right to Data Portability<\/h2>\n<p>You have the right to obtain from us all your personal data that you have provided to us and that we process based on the performance of the contract. We will provide your personal data in a&nbsp;structured, commonly used and machine-readable format. In order for us to easily transfer data upon your request, it can only be data that we process automatically in our electronic databases. In this form, we cannot always and under all circumstances transfer all data that we keep in paper form.<\/p>\n<h2>E.6 Right to Object to Processing<\/h2>\n<p>You have the right to object to the processing of personal data carried out on the basis of our legitimate interest. We will stop processing your personal data unless we have compelling legitimate grounds to continue such processing.<\/p>\n<h2>E.7 Right to Lodge a&nbsp;Complaint<\/h2>\n<p>The exercise of rights in the above manner does not affect your right to lodge a&nbsp;complaint with the Office for Personal Data Protection. You can exercise this right especially if you believe that we process your personal data unlawfully or in violation of generally binding legal regulations.<\/p>\n<p>You can lodge a&nbsp;complaint with the Office for Personal Data Protection, which is located at Pplk. Sochora 27, 170&nbsp;00 Prague 7.<\/p>\n<h2>F. HOW CAN INDIVIDUAL RIGHTS BE EXERCISED?<\/h2>\n<p>In all matters related to the processing of your personal data, whether it is a&nbsp;query, exercise of a&nbsp;right, filing a&nbsp;complaint or anything else, you can contact us through the following contacts:<\/p>\n<ol type=\"a\">\n<li>By email at: recepce@twill.cz<\/li>\n<li>In writing at: Francouzsk\u00e1 70, 602&nbsp;00, Brno.<\/li>\n<\/ol>\n<p>We will process your request without undue delay, but no later than within one month. In exceptional cases, especially due to the complexity of your request, we are entitled to extend this period by an additional two months.
